Terms of Service
If you become a member of Peachy Designs, you agree to our Terms of Service. These Terms of Service are for the purchase of your membership and for the downloadable content provided by Tyffany Hartman and Peachy Designs (owned by Southern Peach Co, LLC). By purchasing any products on Peachy Designs, YOU, the Purchaser, agree to the following terms:

Refunds

If you purchase a Peachy Designs membership, you will have access to exclusive, members-only content (including digital downloadable content). Because the product is digital and you have access to the content upfront, we do not offer refunds – all sales are final. It is your responsibility to log in, access, and download the contents inside the membership site. If you do not log in or access the membership site, or if you choose not to download the contents, no refunds will be given.

Membership Renewal & Cancellation

If you are a Peachy Designs member, you understand that your membership will continue to renew until it is canceled. You are responsible for canceling your subscription by contacting us and requesting cancellation. If you do not want your subscription to renew, you will need to cancel your membership BEFORE your renewal date which is shown on your receipt. Please allow up to 7 business days for us to process your cancellation. Once your membership account has expired, access to the membership and its contents will no longer be available. You are responsible for downloading any content you want PRIOR to your membership cancellation. You may cancel your membership at any time.

Product File Formats

As a member, we trust that you understand the difference between file formats. We offer high-resolution JPG and PNG (raster-based) file formats. We do not offer vector files such as SVG formats. If you are not satisfied with this, we will not offer you a refund of your membership purchased for failure to understand that we do not supply members with SVG or other vector formats.

Right to Refuse Service

We have the right to cancel your membership and remove access to our site if you use our graphics in a way that is not allowed by our terms of service. If you violate our terms of service, you will not be refunded.

Licensing

A member may:
You can use the graphics on your personal website or computer. You can also use them in digital or print advertisements. The graphics can be cropped, changed colors, and overlaid with text or other graphics. You can also make design prints for personal or commercial use. The graphics can be used to promote your own products and services on your website and social media channels.

A member may not:
You are not allowed to resell, relicense, sub-license, or redistribute the graphics without written permission from Peachy Designs. You are also not allowed to use the graphics in any pornographic, obscene, illegal, immoral, libelous, or defamatory manner. Furthermore, you are not allowed to scan, copy, duplicate, distribute or reproduce the graphics in order for a third-party to use them in any way. Finally, you are not allowed to make the graphics available for download.

Summary of Terms and Conditions

Peachy Designs is for both personal and business use. You are allowed to create products for sale using any of our graphics, as long as you don’t sell our graphics by themselves. They can be sold in digital form, but you must add multiple other elements and/or text with our graphic to create a new design.
Changing the color of a graphic and reselling it is not allowed.

The membership site contains graphics in the form of png, jpeg and PDF graphics. We do not offer cut files or other vector graphics. We trust that you know the difference when signing up. If you don’t, please contact us for help before you sign up.
You may use our graphics to make a new design but you can’t just sell them by themselves. You must add multiple other elements and/or text with our graphics to resell digitally. You cannot sell products that include our graphics or any of the content on this website without compressing or flatting the graphics. For example, if you sell invitations and release files in PSD (Photoshop) or other layered formats, the layer that contains our graphics must be compressed or flattened and merged to another layer so that our graphics cannot be extracted and used by the buyer for another purpose. If you are not sure how to do this, please contact us for help.

Ready to Print (RTP) files may not be sold as digital files. You may sell products that have the design printed on them. You are allowed to use the RTP files for other products, such as mugs, drink wraps, and bags. However, you are not allowed to sell the ready to print files as digital files.

You are responsible for protecting the graphics you download. We recommend that you back up your files on two different devices (e.g. an external hard drive and a cloud service like Dropbox or Google Drive). If your computer crashes, we are not responsible for any lost graphics. There are no exceptions to this policy.

If you do not want to be billed for future membership dues, you can cancel before the next auto-renewal. It is the responsibility of the member to cancel their membership if they no longer want it. There are no refunds.

Copyright of all graphics and any content on this website remains with Peachy Designs. Copyright is not transferred to the member.

You may not resell our graphics as is. If you want to sell digital downloads, we require that you add multiple other elements and/or text with our graphics to your design in a compressed (flattened) digital file format. If you’re not sure, please ask us. We’re happy to help!

We have the right to refuse membership to anyone at any time. If someone does not follow the terms of use, we have the right to cancel their membership without a refund. We also have the right to not allow people to renew their membership. Copyright, title ownership, and all rights now and in the future, remain exclusively with Tyffany Hartman of Peachy Designs. Tyffany Hartman with Peachy Designs retains all rights, license, copyright, title and ownership of the graphics and other files on the Peachy Designs membership site.
